Terms of Service
These terms are the agreement between you and Tech Serenity IT (registered company name, Commercial Registration No. commercial registration number, registered address) for use of the Resalian platform. By creating an account or using the service you accept them.

1. Definitions
- "We", "us", "Resalian" — Tech Serenity IT, the owner and operator of the platform.
- "You", "Customer" — the business or person holding an account.
- "Recipient" — a person you send a message to through the service.
- "Customer Data" — everything you upload or generate, including contact lists, message content, templates and segments.
- "Meta" — Meta Platforms, Inc. and its affiliates, which operate WhatsApp, Facebook and Instagram.
2. The service
Resalian is a hosted platform for sending business messages over the WhatsApp Business Platform, managing the conversations that result, and segmenting customers. We provide the software and the delivery pipeline; Meta operates the messaging network itself.
You need your own WhatsApp Business Account and an approved sending number. Resalian helps you connect and configure these, but the account relationship with Meta is yours, and Meta's approval decisions are theirs alone.
3. Your account
- You must provide accurate registration details and keep them current.
- You are responsible for the confidentiality of your credentials and API keys, and for everything done under your account.
- API keys are shown once at creation. If a key is exposed, revoke it in the dashboard immediately — you can do this yourself at any time.
- You must be at least 18 and able to enter a binding contract.
- Tell us promptly at support@techserenityit.com if you suspect unauthorised access.
4. Recipient consent — your responsibility
You must have a lawful basis and, where required, prior opt-in consent to message every recipient. This is not a formality. It is the single most common reason a business loses its WhatsApp number.
You represent and warrant that:
- Every recipient has agreed to receive messages from you on the number you hold, in a manner that satisfies applicable law;
- You can produce evidence of that consent on request;
- You will honour opt-out requests promptly and permanently;
- You will not send marketing to anyone on a do-not-contact list applicable to you;
- Your contact lists were obtained lawfully and were not purchased, scraped or harvested.
Resalian automatically detects common opt-out replies and suppresses those recipients from all future campaigns. This is a safety net, not a transfer of responsibility. Marketing rules in your market — including telecoms regulations governing permitted contact hours — remain yours to comply with. The platform provides sending-hour controls to help; configuring them correctly is your decision.
5. Meta and WhatsApp rules
Your use of Resalian is also subject to Meta's terms, including the WhatsApp Business Messaging Policy, the WhatsApp Business Solution Terms and Meta's Commerce Policies. Those terms apply to you directly and through us. Where they conflict with these terms in relation to message delivery, Meta's terms prevail because we cannot deliver messages in breach of them.
You acknowledge that:
- Meta must approve every message template before it can be sent, and may reject or revoke approval at any time for reasons outside our control;
- Meta enforces a 24-hour customer service window during which free-form replies are permitted; outside it, only approved templates may be sent;
- Meta assigns your number a quality rating and a messaging limit, and may reduce either — or suspend the number entirely — based on recipient reports and blocks;
- Meta charges for conversations, and those charges are separate from our fees (see section 7);
- We are not responsible for Meta's decisions, outages, pricing changes or policy changes, and cannot reverse them.
6. Acceptable use
You must not use Resalian to send unlawful, deceptive, harassing or harmful content, to impersonate anyone, to circumvent opt-outs, or to send to people who have not consented. The full list is in our Acceptable Use Policy, which forms part of these terms. Breach of it may result in immediate suspension under section 12.
7. Fees, message costs and billing
- Subscription fees and any included allowances are those set out in your written order or order form agreed with us.
- Meta charges separately for conversations. Depending on your arrangement, these are either billed to you directly by Meta or passed through by us at cost plus any stated margin. Message volume drives this cost, so a large campaign has a cost consequence you should confirm before sending.
- Fees are payable monthly in advance and are exclusive of VAT and other taxes, which you are responsible for.
- Fees are non-refundable except where required by law or expressly stated. We do not refund message costs for campaigns you sent by mistake — the dashboard requires an explicit confirmation before any campaign sends.
- We may change pricing with at least 30 days' notice. If you do not accept a change, you may terminate before it takes effect.
- Overdue accounts may be suspended after 14 days' notice.
8. Data and content
Customer Data is yours. We claim no ownership of it. You grant us only the licence needed to host, process and transmit it in order to provide the service, and to make backups.
We process Customer Data as your processor, on your documented instructions. The terms of that processing — including retention, deletion, sub-processors and the data-minimisation options available to you — are in the Data Protection Rules, which form part of this agreement.
You may export your data at any time through the dashboard or the API. On termination you may export for 30 days, after which we delete Customer Data other than records we must retain by law and opt-out hashes, which are kept indefinitely so that unsubscribes are never lost.
9. Availability and support
We aim for high availability and run on Cloudflare's global network, but we do not offer a contractual uptime guarantee unless one is stated in a separate written agreement. Planned maintenance will be notified in advance where practical.
Support is provided by email at support@techserenityit.com during Sunday to Thursday, 09:00–18:00 Oman time (GMT+4). Message delivery depends on Meta's network; delays or failures originating there are outside our control.
10. Intellectual property
Resalian, including its software, design, documentation and branding, is owned by Tech Serenity IT and protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not copy, reverse engineer, resell or create derivative works from the platform without our written permission.
WhatsApp, Facebook and Instagram are trademarks of Meta Platforms, Inc. Resalian is an independent product and is not affiliated with, endorsed by or sponsored by Meta.
11. Future features
We describe planned functionality — including Facebook and Instagram campaign support — on our website and in communications with you. Those descriptions are statements of intent, not commitments. Your agreement is for the service as it exists today, and you should not subscribe in reliance on a feature that has not yet shipped. If a planned feature is material to your decision, ask us to put a commitment in writing and we will either do so or tell you we cannot.
12. Suspension and termination
We may suspend or terminate your access if:
- you breach these terms or the Acceptable Use Policy;
- your use threatens the security, stability or reputation of the platform or other customers;
- Meta requires it, or suspends the underlying account or number;
- payment is overdue beyond the grace period; or
- we are legally required to.
Where circumstances allow, we will warn you first and give you a chance to fix the problem. Where the risk is immediate — active abuse, a security incident, a Meta demand — we may act first and explain immediately afterwards.
You may cancel at any time from the dashboard or by writing to us. Cancellation takes effect at the end of the current billing period unless stated otherwise.
13. Warranties and disclaimers
We provide the service with reasonable skill and care. Beyond that, and to the maximum extent permitted by law, the service is provided "as is" without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
We specifically do not warrant that:
- every message will be delivered — delivery depends on Meta, on mobile networks and on the recipient's device and settings;
- Meta will approve your templates, maintain your quality rating, or keep your number active;
- the service will be uninterrupted or error-free;
- segment scores, engagement metrics or churn indicators are predictions of commercial outcomes. They are calculations over the data available, presented to inform your judgement, not to replace it.
14. Limitation of liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill, business or anticipated savings.
- Our total aggregate liability arising out of or in connection with this agreement is limited to the fees you paid us in the 12 months immediately preceding the event giving rise to the claim.
- We are not liable for loss arising from Meta's acts, omissions, policy decisions, pricing or outages; from your breach of section 4 or 5; or from message content you chose to send.
15. Indemnity
You will indemnify Tech Serenity IT against claims, damages and reasonable costs arising from: your message content; your lack of a lawful basis to contact a recipient; your breach of these terms, the Acceptable Use Policy or Meta's rules; or your infringement of a third party's rights.
16. Changes to these terms
We may update these terms as the service develops. Material changes will be notified by email and in the dashboard at least 30 days before they take effect. Continuing to use the service after that date means you accept the revised terms; if you do not, you may terminate without penalty before they apply.
17. Governing law and disputes
These terms are governed by the laws of the Sultanate of Oman. The courts of the Sultanate of Oman have exclusive jurisdiction over any dispute, save that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
Before starting proceedings, both parties agree to attempt in good faith to resolve the dispute by discussion for at least 30 days.
